AVCP Realty assures that Native landowners of federally restricted Native allotments and Native townsites receive the maximum personal benefits from their landholdings. The Realty Department protects the rights of individual Native property owners. We advise, counsel, and offer technical assistance on all real estate transactions requested by the owner.

General Information on Restricted Native Land and Real Estate Services

Native people who recieve title from the federal government for Native allotments or townsites own the land as 'restricted property'. When a restricted property owner wishes to convey his or her property, including sales, leases, mortages, gift deeds, or other transactions, that conveyance requires federal approval for the transaction to be valid. Restricted property is owned by the Native individual and carries with it the advantage of federal protection.
Services
  • ANCSA Oral History. The ANCSA Oral Historian provides serviecs to organize and initiate topical indexing of the ANCSA 14(h)(1) Historic and Cemetary sites research between 1975 and 1995. The Oral Historian coordinates resources and interagency effort between Calista Corporation and AVCP relating to the copying, archiving, storage, collection maintenance, cataloging and indexing of the collection as well as planning long-term regional efforts for transcribing and stranslating the collection.
  • Archaeology. The Archaeology Program manages archaeological resources through a combination of public education, conservation, law enforcement and information recovery. Archaeological assessments and consultation undertaken by the AVCP staff archaeologist are required by law under Section 106 of the National Historic Preservation Act (NHPA) and the National Environmental Policy Act (NEPA). The 1992 amendments to NHPA require that Federal agencies closely consult with tribes, both for projects on and off tribal lands. The AVCP archaeologist can assist with this process, as well as assist with cultural heritage projects undertaken at the local level. Federal authority extends only to restricted property. However, federal and state agencies and federally-funded or licensed private organizations must comply with federal law regardless of property ownership.
  • Forestry/Firewise. Forestry provides Native allotment owners with services and consultation in forestry. Services include forest development and management, insect and disease control, surveying, timber harvesting, mapping, trespass investigations, real estate/timber appraisals assistance and fire protection. Through education and communication, Forestry promotes sustainable management of allotment lands and resources. Firewise provides fire preparedness through inventory of lands, determination of hazard fuel reduction needs and fire planning projects. Firewise also provides critical information to the necessary agencies when a fire incident is approaching an allotment. Both programs include GIS/GPS development for accurate tracking and accountability. Our Forestry/Firewise Specialist is a member of the Alaska Wildfire Cooperating Group (AWFCG) steering committee.
  • Native Allotments. The Native allotment staff assists Native allotment applicants in receiving final certification of their allotment from the Bureau of Land Management. Staff perform requirements necessary for certification, including: client assistance in proving use and occupancy of land; response to BLM inquiries; verification and preparation of accurate legal descriptions; preparation of maps; reconstruction of applications and conflict resolution. The Native allotment also staff work with Vietnam Veteran allotment applicants as well the State of Alaska and ANCSA Corporations for processing reconveyances.
  • Probates. The AVCP Realty Probate Staff are responsible for completing probate packages for those Native landowners who have passed away. Our staff work closely with the family members of the deceased landowner to collect all information required to complete the federal probate process.
  • Transactions. Our Transaction Staff provides services for sales, leases, gift deeds, mortgages, rights of way/easements, partitions, subdivisions, exchanges, trespass and boundary investigation and revocable use permits. The Staff work one-one-one with property owners in order to ensure they receive the maximum benefit from the transaction and that the transaction is completing according to federal regulations.
  • Will Preparation. Will preparation for restricted landowners is another service Realty provides. It is important that owners of restricted property execute a will so that their property passes to whom they want it to. Executing a will also helps limit fractionated interests (multiple owners) on restricted property.
